Terms of Use

These Terms of Use ("Terms") govern your access to and use of the VideoShot mobile application (the "App") operated by Obzena LLC ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

VideoShot is an AI-powered video generation application that allows users to create videos from text prompts and reference images. The App utilizes third-party artificial intelligence services to process your inputs and generate video content.

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements.

3. Account and Authentication

• The App uses anonymous authentication via Firebase. You are not required to provide personal information such as your name or email to use the App.
• Your anonymous account is tied to your device. If you uninstall the App or change devices, your account and associated data (including video history and remaining credits) may be lost.
• You are responsible for maintaining the security of your device and account.

4. AI Data Processing and Consent

4.1 Third-Party AI Processing

When you initiate video generation, your input data is transmitted to and processed by KIE API, a third-party AI service provider. Specifically:

• Your text prompts are sent to KIE API to generate video content.
• Any images you upload as reference material are sent to KIE API for processing.
• Video parameters (aspect ratio, style, model selection) are sent to configure the generation.

4.2 Data Handling by KIE API

• Your input data is processed solely for the purpose of generating the requested video.
• Your input data (text prompts, images) is not permanently stored by KIE API. It is retained only temporarily during the active generation process.
• Your data is not used by KIE API to train or improve their AI models.
• Generated videos are temporarily hosted by KIE API for retrieval and are subsequently deleted.

4.3 In-App Consent

Before your data is sent to KIE API, the App will display a consent alert. You may choose to decline, in which case no data will be sent and no video will be generated. Proceeding with generation constitutes your consent to the data processing described herein.

5. Subscriptions and Credits

5.1 Credit System

• Video generation requires credits. Different AI models and quality levels consume different amounts of credits.
• Credits are managed through RevenueCat and are tied to your account.
• Credits are non-transferable and have no cash value.

5.2 Subscription Plans

• The App offers weekly, monthly, and yearly subscription plans that provide credits for video generation.
• Subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions.
• One-time credit purchases are also available.

5.3 Billing and Renewal

• Payment is charged to your Apple ID account upon confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your Apple ID Account Settings.
• Unused credits from subscription plans expire at the end of the billing cycle as configured in our subscription terms.

5.4 Refunds

• All purchases are processed through Apple's App Store. Refund requests must be directed to Apple in accordance with their refund policy.
• If a video generation fails due to a technical error on our side, the credits used for that generation will be automatically refunded to your account.

6. Acceptable Use

You agree not to use the App to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Generate content that infringes on any third party's intellectual property rights, including copyrights, trademarks, or rights of publicity.
• Generate content depicting real individuals without their consent, including deepfakes or misleading media.
• Generate content that promotes violence, discrimination, or hatred against any individual or group.
• Generate child sexual abuse material (CSAM) or any content exploiting minors.
• Attempt to reverse engineer, decompile, or disassemble the App or its underlying AI systems.
• Use automated systems or bots to access the App or generate videos in bulk.
• Circumvent any security measures, credit limitations, or access controls.
• Use the App for any purpose that violates applicable local, national, or international law.

We reserve the right to terminate or suspend your access to the App immediately, without prior notice, for any violation of these Terms.

7. Intellectual Property

7.1 App Ownership

The App, including its design, code, features, and content (excluding user-generated content), is owned by Obzena LLC and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7.2 User-Generated Content

• You retain ownership of the text prompts and images you provide as input.
• You are granted a license to use the AI-generated videos for personal and commercial purposes, subject to these Terms and applicable laws.
• You are solely responsible for ensuring that your input content (text prompts, images) does not infringe on any third party's rights.
• We do not claim ownership of the videos generated through the App.

7.3 AI-Generated Content Limitations

• AI-generated content may not be unique. Other users providing similar prompts may receive similar results.
• We do not guarantee that AI-generated content is free from errors, biases, or unintended outputs.
• You are responsible for reviewing all generated content before using or distributing it.

8. Disclaimers

8.1 Service Availability

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee that the App will be uninterrupted, error-free, or available at all times. Video generation depends on third-party services (KIE API) that may experience downtime or technical issues beyond our control.

8.2 AI Output Quality

We do not guarantee the quality, accuracy, or suitability of AI-generated videos. Results may vary based on input quality, prompt specificity, and AI model capabilities. Generated videos may contain artifacts, inaccuracies, or unexpected content.

8.3 No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBZENA LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OBZENA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP.

Our total liability for any claims arising under these Terms shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Obzena LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any third party's rights, including intellectual property rights.
• Any content you generate, upload, or distribute through the App.

11. Termination

• You may stop using the App at any time by uninstalling it from your device.
• We may terminate or suspend your access to the App at any time, with or without cause, with or without notice.
• Upon termination, your right to use the App ceases immediately. Any unused credits will be forfeited.
• Active subscriptions must be canceled through Apple's App Store to prevent future charges.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Obzena LLC regarding your use of the App.
